The 5th Civil Chamber of the Court of Rio kept a lower court ruling that sentenced a woman to pay her husband R$ 3,000, in damages.
The author filed the lawsuit because, in May 2010, his ex-wife went to his workplace and found him, and physically and verbally assaulted him, only stopping with the assistance of two colleagues. For him, as well as minor injuries, there was public humiliation.
For the rapporteur, Tereza Cristina Gaulia federal judge, the author succeeded in proving the public humiliation which was exposed, which creates a duty to indemnify. "Right, so the sentence, in determining that the defendant indemnify the damages suffered by the author, this remaining evidenced before the public humiliation happened in front of the work of the author, and witnessed by some of his colleagues, which necessarily shook his mental state. Should be considered also suffered physical injuries, even minor, since the parties have reached mutual physical aggression, "she concluded.
